El antes art. 37.3 fue declarado incompatible por la DCP 0158/2016; sin embargo, el estatuyente, optó por eliminarlo y en atención al art. 116 del CPCo, que establece el objeto del control de constitucionalidad de los proyectos de estatutos o cartas orgánicas, es confrontar el contenido de dichos instrumentos normativos con la Constitución Política del Estado y garantizar la supremacía constitucional y al haberse eliminado dichos numeral, no existe contenido normativo que confrontar; y no se realizó6 el control de constitucionalidad.
