Sobre el párrafo introductorio
La DCP 0158/2016 declaró la incompatibilidad del párrafo introductorio porque establecía que se: “reconoce los deberes establecidos en el ordenamiento constitucional y jurídico del país” al respecto se señaló que el reconocimiento por la Carta Orgánica Municipal de los deberes establecidos en la Ley Fundamental, bajo el principio de supremacía constitucional, no es admisible, puesto que los deberes reconocidos en la Norma Suprema solo deben ser acatados por todas sus instancias, como también por las entidades territoriales autónomas (ETA), dicho de otro modo, una ETA, no puede arrogarse la competencia de su reconocimiento, cuando lo que atañe es su sometimiento y cumplimiento; de la lectura, se constata que el mismo fue adecuado conforme la referida declaración.
