The First-tier Tribunal granted SoSE’s application to be made a Respondent to the Appellant’s appeal against the Commissioner’s decision notice. The Appellant and SoSE were both represented by counsel at the hearing before the First-tier Tribunal (SoSE were represented by the same counsel who now represents them before the Upper Tribunal but the Appellant was represented by different counsel). The Commissioner was not represented although he had provided quite extensive written submissions opposing the appeal.
