Personal information
Section 40(2) FOIA provides that information is exempt information if it constitutes personal data and “the first, second or third condition below is satisfied”. “Personal data” has “the same meaning as in Parts 5 to 7 of the Data Protection Act 2018 (see section
3(2), (4) and (14) of that Act)” (section 40(7)). Section 3(2) of the 2018 Act provides that ““personal data” means any information relating to an identified or identifiable living individual”.
