Ground 2 – Tribunal’s assessment of the law of confidence, and application of section 41 of FOIA
Ground 2 is that the First-tier Tribunal misdirected itself in law because it misunderstood the law of confidence. Had the law of confidence been properly applied, the Tribunal could not have found the information to be confidential. The Tribunal ‘failed at every step’ of its legal analysis.
