The Applicants’ position was that the Bank did not know there was a material error at the time of the Q3 Update, because of one or more of the following, each of which we consider in turn below.
Uncertainty as to the rules on classification.
Data issues, including the application of the SME supporting factor and the possibility that some of the CLIP loans were residential mortgages and so had been wrongly classified.
Uncertainty as to whether the increased RWAs could be significantly reduced or eliminated by one or more “mitigants”.
