The challenges put by the Traders to the Authority’s case included: the abusive scheme would not have worked (looking at market impact, liquidity and volatility) and would not therefore have facilitated the trading of the Small Orders; the scheme would not have benefitted the Traders; it would have been easily detected; and it does not explain all the features of the Traders’ trading activity during the Relevant Period.
