I have found above that the failure of redaction functionality constituted a breach of contract. I accept that the provision of a third party product which fails is not, of itself, a failure to have adopted GIP. Nevertheless, DBS adopted a reasonable solution in introducing a solution from Adobe and purchasing the necessary licences. I accept the factual evidence of Ms Graves (at paragraph 34(d) of her Third Witness Statement. Mrs Wall’s main challenge from a quantum perspective on the basis of certain names appearing more than one fell away once it was explained that some individuals were requesting more than one licence for their team members.
The Counterclaim at item 20 of the Updated Schedule of Loss in the sum of £8,270 succeeds.
