TCS’s pleaded case is that, notwithstanding the delay in relation to R1-B&B, by 7 September 2017, when R1-B&B went live, TCS had designed the R1-D part of the Solution and had developed it to the extent that it was ready for Final Systems Integration Testing. It contends that, in the event, however, Final SIT could not proceed in September 2017 or at all owing to DBS’s persistent failure between September 2017 and September 2018 (the date R1-D was de-scoped) to make critical decisions and/or to complete activities that were its responsibility (the specifics of which are considered below) and without which Final SIT could not proceed.

DBS plead that as at September 2017, the R1 Disclosure part of the Solution was not ready for Final Systems Integration Testing. Further, the parties had anticipated that a period of 12 months would be required to integrate and test R1 Disclosure. ‘The November 2017 deadline for delivery of R1 Disclosure’ was therefore unachievable even if Final SIT could have been commenced in September 2017.
