R0 N-1 Sustainment Costs – Item 7 of the Updated Schedule of Loss
DBS pleads that at service transfer, many of the software products within R0 needed to be updated due to TCS’s failure to maintain the currency of the software deployed. DBS contends that it has been forced to engage a third party, CGI, to undertake work to update the system, and that this work is ongoing.
The claimed sum of £1,053,759 relates, as Mr Hain explains in his First Report, to 50% of the cost of one CGI purchase order (the other 50% is claimed within the R1 N-1 Sustainment Costs). There is no explanation or evidence which supports a conclusion that any part of these costs relates to the only period for which a claim would be valid. This claim is also a claim properly characterised (as pleaded) as caused by non-delivery, rather than ‘delay’, as explained above in respect of Item 6.
There are, in any event, other fundamental difficulties with the claims, as discussed in relation to Updated Schedule of Loss item 15, further below.
This claim fails.
