TCS relied upon the evidence of Mrs Vikki Wall, and DBS upon the evidence of Mr Graham Hain. Both experts approached their oral evidence professionally and sought generally to assist the Court with their opinions, although both at times had seemed, at least in their reports, to have adopted a rather more critically rigorous approach to assessing the quantum of the other parties’ claims than when reviewing their own client’s. Nevertheless, their joint report and the various spreadsheets produced by them have been of considerable assistance, particularly in the context of the Volume Based Service Charges claim, for which I am grateful.
