I have been assisted enormously by Counsels’ lengthy written Closing Submissions, supplementing their full written Opening Submissions. The numerous cross references to witness and documentary evidence and the relevant passages of oral evidence given under examination have been invaluable.

I have also been assisted greatly in navigating through the enormous quantity of material referred to by the schedules produced by the parties at my request upon Closing, which identified in relation to each claim and counterclaim the relevant parts of the pleadings, factual witness statements, and expert reports, and those passages of live evidence relied upon, together with a clear identification of the claimed amount, those claims no longer pursued and Written Closing Submission references. In a case like this, a single and authoritative source of the material each party, in Closing, relies upon is indispensable. In the arbitration world, such a Schedule is generally referred to as a ‘Spigelman Schedule’, named after the Honourable James Spigelman AC KC, former Chief Justice of New South Wales, and I shall do likewise in this judgment. I look forward to its broader adoption in complicated litigation as a standard tool to assist the task of judgment writing.
