This was not a specific complaint made in paragraph 106 of the Amended Defence and Counterclaim, and neither the experts nor the factual witnesses give any description of how DBS failed to comply with this obligation. In principle, this appears to be a similar complaint to the Master Document List. In the v09 spreadsheet DBS raised two comments. The first related to clarification that the transfer of documents was not to be held up if they did not happen all to be ready at the same time, which TCS accommodated. The second comment sought clarification within the STP about what information had already been identified. As TCS rightly responded, the obligation was for TCS to provide proposals as to how this information will be identified, not to identify it as part of the STP. TCS’s STP included the proposal for how it would be gathered and presented to DBS.

I find that STP v0.9 was not in breach of Clause 3.2.3 of Schedule 2-11.
