Neither of Mr Britton’s two analyses are in my judgment reliable bases upon which the Court can conclude that the critical path ran through infrastructure throughout the majority of R1-B&B, or indeed what the particular durations and causes of critical delay were along that path (so as to assess whether they were causes which triggered an entitlement under Clause 7). Nor do they provide any basis for me to make a determination of the date by which TCS would have Achieved R1-B&B, having rejected, as I do, TCS’s pleaded case that there would have been no delay, save for 18 days.
