DBS claims the sum of £3,461,764, although it accepts that it must give credit against this for the £892,500 which would have been recoverable by way of Delay Payments (even though, for the reasons set out above, these are in fact irrecoverable).

Although TCS appeared to suggest that there was no Milestone for Basics against which delay could be alleged, this was not pursued in Closing which adopted the R1 Barring and R1 Basics Go-Live dates of 15 September 2016 and 1 January 2017 respectively.

The sums claimed by DBS are:

On the face of it, the delay to the R1-B&B Milestone exceeded 6 months so, pursuant to Clause 6.3 of the Agreement, the primary remedy of Delay Payments is not DBS’s exclusive financial remedy. It would be entitled to claim damages demonstrated to be in excess of the Delay Payments otherwise recoverable.
