DBS’s pleaded case is that the Basics Portal designed by TCS was rejected by DBS because of its inadequate quality, and because it did not comply with GDS standards, including DbD. Following the rejection of the Basics Portal, DBS aver that Mr Charles of IBM suggested that DBS would be able to develop GDS-compliant screens itself. A prototype was built by DBS with the assistance of GDS and presented to TCS, but DBS allege that TCS declined to change the work it had done on the Basics Portal. It is then pleaded that as a result of these issues, DBS decided to remove the Basics Portal from TCS’s scope of work and to design the Basics Portal itself. The Basics Portal designed by TCS has never been used.

Neither expert was in a position to evaluate the Basics Portal itself because neither had seen it. All Dr Hunt saw and evaluated was the list of useability issues that were identified by DBS, by IBM and by GDS at the time.

The issues identified by IBM related to a review carried out seemingly informally in August 2016. Mr Craven of IBM emailed Ms Keenaghan of DBS stating, ‘I went through the prototype pages earlier this week and noted a few bits down. Not sure if they will be useful for the heuristic review or not’. The attached PDF attached 7 pages of screenshots with around 12 comments in red, such as the following:
