I have found that it was a condition precedent that DBS promptly issue a Non-Conformance Report in accordance with Clause 6.1 if DBS is then to have the options set out in Clause 6.2, which includes Delay Payments. It did not do so. Its claim for Delay Payments fails.
If I am wrong about that, its claim in respect of R1-B&B in the sum of £892,500 would have succeeded in full, and its claim in respect of R1-D would have succeeded for the period from 28 November 2017 to 6 February 2018, a period of 70 days (in the sum of £700,000).
