It is DBS’ case that, by reason of the wording of Clause 5.6, compliance with Clauses 5.1 to 5.3 is required in order for TCS to claim compensation (including general damages) for Delays attributable to ‘AUTHORITY Cause’. Similarly, it is TCS’s case that DBS’ entitlement to recover Delay Damages pursuant to Clause 6.2.3 is conditional upon compliance with the substance of Clause 6.1.
